High Court Dismisses Injunction Bid in Emrail Rail Subcontract Dispute

SHAH ALAM, April 2026 — The High Court has dismissed an application by Puncak Gali Harmoni Sdn Bhd seeking an injunction against Emrail Sdn Bhd in relation to a subcontract dispute tied to a government railway rehabilitation project in Kelantan.

The dispute centres on a subcontract for rail restoration works between Gua Musang and Tumpat, where Puncak Gali claims it was appointed under a conditional letter of award and subsequent undertaking issued by Emrail. Emrail, however, maintains that the arrangement was subject to conditions that were never fully satisfied, meaning no binding subcontract was formed.

In its ruling, the court found that damages would be an adequate remedy should the main suit eventually succeed, and determined that the balance of convenience and public interest did not justify halting ongoing rail works. The decision effectively allows the rehabilitation project to continue while the underlying contractual dispute proceeds through the courts.

The case is part of a wider legal battle involving interim injunctions and appeals, with earlier Court of Appeal intervention having temporarily reinstated an injunction before the matter was reheard at the High Court level. Higher courts had also directed that the dispute be reassessed due to procedural concerns in earlier rulings.

More broadly, the case reflects recurring challenges in Malaysia’s rail infrastructure delivery landscape, where subcontracting structures, conditional award letters, and project execution responsibilities often lead to contractual disputes. While such litigation does not necessarily halt national infrastructure development, it underscores the importance of clearer contractual frameworks in large-scale public rail projects to reduce delays and legal uncertainty.
