India, August 2026 – The Chennai bench of the National Company Law Appellate Tribunal (NCLAT) has disposed of an appeal between JSW Mahanadi Power Company and Raigarh Champa Rail Infrastructure Pvt Ltd (RCRIPL) after the companies reached an amicable settlement. The agreement was formally executed on August 6, 2026.
The dispute originated from unpaid invoices issued by RCRIPL under a 2014 coal transportation infrastructure agreement with JSW Mahanadi Power, formerly KSK Mahanadi Power. NCLT had ruled in favour of RCRIPL in September 2021, while NCLAT subsequently directed a 50% payment mechanism for outstanding and future invoices during the appeal.
The settlement follows separate insolvency proceedings involving the two companies. JSW Energy emerged as the successful resolution applicant for both KSK Mahanadi Power and RCRIPL, with the resolution plan for RCRIPL receiving NCLT approval in January 2026. With both entities now under JSW Energy, the companies entered settlement discussions that ultimately resolved the outstanding dispute.
RCRIPL was established as a special-purpose vehicle by the KSK Group to develop railway infrastructure connecting coalfields in the Mand Raigarh area with power stations in Janjgir Champa. The infrastructure also interfaces with the Indian Railways network and supports the movement of coal, other fuels, raw materials and fly ash.
The resolution highlights the strategic importance of dedicated rail infrastructure within industrial supply chains. For the energy and rail sectors, bringing the rail logistics asset and its principal power-generation user under common ownership could simplify commercial coordination and support more integrated management of coal transportation infrastructure in Chhattisgarh.
